Terms & Conditions – Namey by Amy

Effective Date: 26 August 2025

These Terms & Conditions govern the sale of products by Namey by Amy (“we”, “us”, “our”). By placing an order, you (“the customer”, “you”) agree to be bound by these Terms.

1. Nature of Products

All products are handmade and may contain natural variations in colour, size, texture and finish. Such variations are inherent to handmade goods and do not constitute defects.

While high-quality materials are used, we do not warrant against normal wear and tear or natural material degradation over time.

Images, mock-ups and prior works are indicative only. Exact replication is not guaranteed.

2. Orders & Production Allocation

Orders are released in limited quantities and allocated to a specified production month.

By placing an order, you acknowledge and agree that:

  • your order is scheduled for production commencing in the selected month; and
  • the selected month represents the start of production only and is not a guaranteed delivery date.

Payment is required in full at the time of purchase unless otherwise stated.

3. Production Process & Customer Input

Custom and personalised products are created based on information provided by you. You are responsible for ensuring all design details are accurate and complete.

Where applicable, a digital mock-up may be provided for approval. Production will not proceed until approval is received.

We reserve the right to interpret design briefs and produce work in accordance with our artistic discretion, particularly where “freestyle” or open-ended instructions are given.

4. Production Timeframes & Delays

All products are handmade and production timelines are estimates only.

While we endeavour to complete and dispatch orders within the allocated production month, delays may occur. Such delays may arise due to, but are not limited to:

  • delays in customer design approval;
  • supplier or material delays;
  • postal or logistics delays;
  • illness, capacity constraints, or other unforeseen circumstances.

By placing an order, you expressly acknowledge that:

  • custom and handmade products are time-intensive; and
  • delays are an inherent risk of the production process.

We do not guarantee delivery by any specific date.

5. Shipping & Delivery

Risk in the goods passes to you upon dispatch.

We are not liable for loss, damage or delay once the goods have been handed to the relevant postal or courier service.

We will make reasonable efforts to assist with carrier enquiries; however, delivery services operate independently and are outside of our control.

6. Refunds, Returns & Remedies

We do not offer refunds, returns or exchanges for:

  • change of mind;
  • incorrect selections;
  • preference changes.

Nothing in these Terms excludes your rights under the Australian Consumer Law (ACL).

You may be entitled to a remedy where goods are:

  • faulty;
  • not of acceptable quality;
  • not fit for purpose; or
  • not as described.

Handmade variations do not constitute a failure to meet consumer guarantees.

7. Product Use & Safety

All products are decorative items only and are not toys.

They are not intended for use in sleeping environments or within reach of infants or children.

You are responsible for ensuring safe installation, placement and use in accordance with applicable safety guidelines.

8. Intellectual Property

All intellectual property rights in our products, including but not limited to designs, concepts, artwork, styling, product configurations, images, text and branding, remain the exclusive property of Namey by Amy.

You must not, without prior written consent:

  • copy, reproduce or replicate our designs;
  • create derivative works based on our designs;
  • use our designs or products for commercial purposes;
  • resell, manufacture or distribute any substantially similar designs.

This includes the use of our designs as inspiration for commercial products.

Any unauthorised use or infringement of our intellectual property rights may result in legal action, including claims for damages, injunctive relief and recovery of legal costs.

9. Limitation of Liability

To the maximum extent permitted by law, we exclude liability for any indirect, incidental or consequential loss arising from the use of our products.

Our liability, where it cannot be excluded, is limited to the remedies available under the Australian Consumer Law.

You are responsible for ensuring all order details, including delivery information, are accurate at the time of purchase.

10. Early Access & Availability

Access to product releases, including early access via mailing list, does not guarantee availability.

All products are offered on a limited, first-come, first-served basis.

11. Amendments

We reserve the right to amend these Terms & Conditions at any time. The version in effect at the time of your purchase will apply.
